Getting a Divorce while Deployed in the Military

If you are deployed and are considering a military divorce, you may be wondering if it can be done while overseas or in a state other than where your spouse resides. A military divorce under such circumstances may be possible depending on the state in which you live. This is why a woman who is deployed in the military should contact a Virginia divorce attorney who knows about military divorce in that state.

All divorces are subject to the laws of the state, so in the course of your Virginia divorce you will need an attorney who is familiar with:
  • The permitted grounds for a divorce
  • Issues of no-fault and fault-based divorce
  • Requirements for jurisdiction

Many states do allow you to divorce if you were stationed in that state at the time of your deployment, or if you have a current legal residency in that state for a specific period of time.

If your state allows for a divorce while deployed, there are many issues that you and your Virginia divorce attorney will have to work on together and these include:
  • Dissolution agreement
  • Child support arrangements
  • Issues of child custody, including ensuring that your parental rights are protected despite your deployment

Probably the biggest hassle to deal with in a military divorce is the paperwork. Cutting through the legal red tape takes time and know-how. If Email can be used, it makes the process much more efficient. If you are considering a divorce then you will need to seek the advice of a Virginia divorce attorney.
