The 5 Grounds for Divorce in Virginia

  • If the couple has been living apart for a period of 1 year, the law will consider them separated long enough to file for divorce.  
  • The separation period can be reduced to 6 months if the partners have executed a separation agreement and have no minor children. 
  • For adultery (sexual relations outside of the marriage), or for sodomy or buggery. 
  • In situations where one of the partners has been sentenced to a prison term of 1 year or more, and the other spouse ceased co-habiting with him or her after learning of the conviction.  
  • In cases of abuse, where one spouse reasonably fears bodily harm from the other, or in cases of desertion.
