Understanding Virginia Separation Agreement Forms

Embarking on a divorce is difficult for anyone. Even for those partners who have no doubts about their incompatibility and are eager to end their marriage, the act of separation can be difficult for both practical and emotional reasons.

As you begin the process of officially ending your marriage, you should consider a separation agreement. Virginia separation agreements are legal documents that contain the conditions of your separation and divorce.

A separation agreement contains the basic legal language that appears in most types of agreements or contracts. In the opening lines of a Virginia separation agreement, it states that you and your spouse mutually agree to settle your property, custody, and
financial issues

The main portion of the Virginia separation agreement will include the decisions you and your spouse have made regarding issues like child custody and child support, division of property, and spousal support.

It's not always easy to come to agreements about such important matters, but having a separation agreement can make your divorce process go more smoothly. Remember that a separation agreement is binding, and a judge usually takes the agreement as your final decisions regarding all these issues.

It's best not to attempt to execute a separation agreement on your own. Be sure to have a Virginia divorce attorney on your side to make sure that the document is fair and legal.
