Virginia Divorce and Military Housing

If you are living in military housing and are considering divorcing your spouse, there are some important facts to take into consideration.

Service member's spouses have the right to reside in on-base housing as long as their serviceperson spouse lives there with them. These rights are honored when the spouse who is the service member is away from home on military business, but in the case of divorce or separation, the picture changes. 

Once the divorce is final, the non-military member generally needs to leave military housing within 30 days and find alternate living arrangements
. This can understandably cause stress for the spouse who needs to move.

If you are a Virginia woman married to a military serviceman and are considering a divorce, it is in your best interests to plan and be prepared for the life changes that will occur once your marriage is over.

Before and during your divorce proceedings, it would benefit you to take steps toward your new independent life, which means taking ample time to locate and prepare housing alternatives before you are forced to relocate.

In cases of domestic violence, harassment, or other forms of disruptive strife during a marriage, the service member spouse is usually moved out of the family home and into the military barracks. The abusive spouse does not have the authority to evict his family from the military housing, or revoke any of their other rights or benefits.
