Virginia Spousal Support Calculation Basics

One of the most common questions about spousal support is, "how much will I get?" Understand that each case is unique and a Virginia family court will determine the amount of spousal support that's appropriate for your situation.

Virginia Spousal Support Guidelines

There are guidelines to help calculate Virginia spousal support, but there are often other factors that go into the judge's decisions: 
 

  • age and health of the parties;
  • duration of the marriage;
  • monetary and non-monetary contributions of both parties;
  • earning capacity of both parties (including skills, education, and training);
  • property interests of the parties; and
  • as well as other factors.  

If no child support is involved, the higher-paid spouse pays the recipient 30% of gross income minus 50% of the lower earning spouse's income. If child support is involved, the payer pays the recipient 28% of his gross income less 58% of the recipient's gross income.
