What are the rules about traveling out of state with the kids after divorce?

A:

In general, a custodial parent can freely travel out of state with the children for holidays or vacation when they are having a visit, unless your court order says otherwise.

In most cases, the decisions regarding vacation and holiday travel are set out in the couple's Parenting Plan or Visiting Schedule as part of their Virginia divorce.

It's best to have detailed, written guidelines for visitation rather than just a loose plan
. Phrases like "reasonable visitation" are up for interpretation and can lead to confusion and arguments.

It's wise for the traveling parent to inform the child's other parent of the holiday or vacation itinerary. That way, the other parent can be informed and know that their feelings are being respected.

A detailed plan isn't just good for parents; it benefits the children as well. Kids enjoy a predictable schedule and they'll be a lot happier and more secure if they know which parent they're going to be with, when they'll be there and for how long.

A Virginia divorce brings to light many new questions for parents, particularly those involving child custody issues.

Holidays and vacations should be fun and enjoyable times for children and parents alike. Being sure of your visitation rights and limitations can help you to feel more relaxed as you celebrate these special times.

Speak with your Virginia child custody attorney if you have any questions or concerns about your custody arrangement.

Concerns about children, mortgages, and even just paying the bills or buying groceries can easily become overwhelming.

A Virginia child custody attorney at Hofheimer/Ferrebee can examine the specifics of your case to help you decide how much support to ask for, what child custody arrangement will work best for you and your children, and how to fairly divide your marital assets.
