Important Financial Records In a Virginia Divorce (Part B)

Once you have familiarized yourself with the important documents in your married life, it will be time for you to begin establishing yourself as a single financial entity. Separating yourself from your husband financially could be the most liberating act of your pre-divorce life.

How to Become Single Financially before Becoming Single Legally

This is not something you have to do behind your husband's back, unless your husband is abusive, which is another matter entirely. In fact, including your husband in the decision to be financially independent may greatly simplify the entire process. Your Virginia divorce lawyer can guide you through determining the best approach for your individual case.

The following is a list of easy steps toward financial independence prior to your Virginia divorce.
  • Record all spending. Create and maintain a check register. Double-check the accuracy of all credits and debits with your husband. Be sure the ending balance is accurate.
  • Accurately correct the register. Include the check number, amount of payment, date, description of payment, and any fines resulting from the transaction.
  • Be sure the person responsible for each credit or debit is clearly identified. In the "description of transaction" block, be sure to list the name of the person doing the spending as well as the reason money was spent.
  • Specify a cap on withdrawals with both your husband and your bank. Call your bank and set a maximum for withdrawals. This limits the amount of money available for spending before the divorce is final.
  • Limit purchases to household items only. Agree to the opening of separate accounts, but leave a joint account open for household and childcare expenses.
  • Organize your financial records. File your joint finances and individual accounts separately. Your individual accounts and spending records will assist the judge in determining whether you are financially able to support yourself or if you require spousal support from your husband.
