How Is the Amount of Child Support Calculated in Virginia? (Part B)

Your children's medical and dental expenses may also be considered when calculating the Virginia child support amount. Medical expenses include: prescription medication, eyeglasses, orthodontics, and mental health or developmental disabilities services. In most cases, the noncustodial parent is responsible for obtaining health insurance for their children.

If the custodial parent must enroll the children in daycare in order to work, the child-care costs are added to the child support calculation. The child-care costs must be reasonable enough to obtain quality care from a licensed professional, and the custodial parent may be asked to submit documentation verifying the costs.

If one parent is awarded sole custody (also known as primary custody), child support is determined by comparing the monthly gross incomes to the combined monthly gross income
. The monthly obligation is calculated by multiplying each party's percentage of combined income by the total monthly child support costs.

If the parents have joint custody, or the noncustodial parent has more than 90 visitation days a year, the amount of Virginia child support will be calculated with these factors in mind.

Virginia Child Support Calculators

There are several child support calculators that can help you determine the amount of child support that is owed in your Virginia divorce case. These calculators, however, are based solely on both parents' income and do not factor any extenuating circumstances.

To use the child support calculator, you must enter the number of children, as well as the gross income for both the custodial and noncustodial parent. After entering this information, you will see your base percentage of obligation, base monthly obligation, and base support obligation.

Refusal to Pay Virginia Child Support

Sadly, there are some parents who refuse to pay Virginia child support. In these cases, the Virginia Social Services Division of Child Support Enforcement may help you track down your ex-husband in order to recover unpaid child support. If he refuses to pay, child support may be withheld from his paycheck.

Speaking to an experienced Virginia divorce attorney who specializes in child support disputes can help you determine the correct amount of child support payments your family requires. At Hofheimer/Ferrebee, we understand that the health and happiness of your child is your #1 concern and we will work with you to address any fears and anxieties that you may have about your child's future.
