Types of Spousal Support in Virginia

The topic of spousal support will probably come up early on in your Virginia divorce proceedings. Perhaps you will request support from your ex-husband. Or if you are the higher wage earner, your ex may request support from you. Your divorce attorney will help you to understand the different types of spousal support in Virginia.

The most common types of spousal support in Virginia include:

  • Temporary Support - this type of spousal support in Virginia is awarded only during the process of divorce or legal separation until a longer-term support agreement can be reached. Typically, the higher earning spouse is required to make a payment to the other spouse so that the non-working or lower wage earning spouse can cover living expenses during the divorce process. Support can come in the form of payment from one spouse to another or through a third party, such as one spouse who pays the other's rent directly to the landlord.
  • Rehabilitative Support - also called limited-term support, rehabilitative support is awarded to a spouse to cover expenses during a period of time to allow them to complete training or education toward a career. This often applies to stay-at-home wives and moms who now need to enter the workforce after a long absence.
  • Long-Term Support - this type of spousal support in Virginia is typically only awarded after the end of a long marriage to an elderly or disabled spouse. The higher wage earning spouse is required to make payments to the other spouse for an extended period of time, sometimes equal to half the length of the marriage, or perhaps indefinitely.
  • Lump-Sum Support - support in the form of one lump-sum payment can be an attractive option for some women going through a Virginia divorce. Receiving a settlement of one payment or a large asset from your marriage can help you avoid capital gains taxes, as long as it is within one year of the date of divorce. It is also not dependent upon your ex-husband's continued state of employment.
