Escaping an Abusive Relationship (Part B)

Even if you recognize that you are in an abusive relationship, you may not know how to escape the situation. Remember that you are not alone despite how isolated this marital abuse has made you feel. There are resources available for women in your situation.

How to Escape an Abusive Relationship

If you've decided to leave your abusive husband, you may fear his reaction. This is especially true of physically abusive relationships. However, you do not have to involve him in any part of your preparations to leave, nor do you need his consent to get out of the house. You can escape the physical premises of your home long before your divorce is filed.

Some steps to take in preparing to leave include:

  • Documenting abusive behavior as it happens (with photos if physical abuse is present)
  • Having all important papers, clothing, toiletries, etc. ready to leave at a moment's notice
  • Becoming as financially independent as possible before you leave: having a bank account in your own name, credit cards in your name only, etc.
  • Plan an escape route. Know exactly where you will go, notify friends or family. (The National Domestic Violence Hotline can provide a list of local shelters for battered women; 800-799-SAFE)
  • Take all necessary steps to stay safe until you leave

Next, it would be in your best interest to consult with an experienced divorce attorney who understands women's issues in Virginia. It is important that the Virginia divorce lawyer you choose has handled cases similar to yours and that they understand the legalities of abusive relationships.

If you have children and are concerned for their safety before the divorce is final, you may wish to seek an immediate order of temporary custody along with a temporary order of protection or a restraining order
. A Virginia divorce attorney with experience in this area can provide assistance now, as well as throughout your entire divorce process.

At this vulnerable time, it is critical that you have exceptional legal representation that not only understands the specifics of your case, but is dedicated to your best interests and that of your family.

The Virginia divorce attorneys at Hofheimer/Ferrebee represent Virginia women who wish to file for divorce.
