The Basic Steps in a Virginia Divorce Proceeding (Part B)

Pendente Lite Hearings

During a divorce there are usually certain issues that require immediate - even if only temporary - solutions until the divorce decree becomes final. These typically include:

  • Temporary child custody and support
  • Temporary use and/or possession of the marital residence
  • Injunctions, financial relief, and the use of other marital assets

Either spouse can request a Pendente Lite hearing to temporarily settle these issues while the divorce proceedings continue. It is imperative that you have a qualified Virginia divorce lawyer with you at this hearing to protect your assets and to ensure you receive the financial support, personal property, and child custody/visitation rights you need until a permanent divorce decree is issued by the court.

If you do not have enough time to hire a Virginia divorce lawyer prior to your Pendente Lite hearing, appear at the scheduled hearing and ask the judge to push the hearing back to a later date in order to allow you time to hire legal representation. After the Pendente Lite hearing has taken place (or was not requested), the divorce proceeding will move into the main hearing phase.

The Divorce Hearing

At your divorce hearing, you and your spouse, along with your Virginia divorce attorneys, will appear before the court to first determine if there are sufficient grounds for a divorce to be granted.

In Virginia there are 2 main types of divorce; a No-Fault divorce and a Fault-based divorce
. Once the court determines if you and your spouse have legal grounds for the divorce to take place, a judge or commissioner reviews the evidence, with each side being given the opportunity to make their case, call witnesses, and so on.

At the end of the divorce hearing, the Judge makes the final decision, which is called a Final Decree of Divorce. While each divorce may require some additional steps such as mediation and depositions , all Virginia divorce cases typically follow the steps listed above.
