The Repercussions of Not Paying Child Support in Virginia (Part B)

Uniform Interstate Family Support Act

If your ex-husband moves out of state and stops making Virginia child support payments, the Uniform Interstate Family Support Act upholds the child support order at his new residence. In order to collect payments, you may consult with your Virginia child support lawyer to file a complaint with the Division of Child Support Enforcement, which will pass your complaint to your ex-husband's state of residence. The other state will send him a notice for a child support hearing.

If you do not know your husband's new address, the state will have to track him down, which could take time. An experienced Virginia Beach divorce lawyer can help you find his address and file the necessary paperwork in order to claim your unpaid Virginia child support.

If your husband ever moves back to Virginia, the child support order can be enforced or modified by the state and order that the unpaid child support be paid to you and your children.

Imputed Income

In an effort to get back at their ex-wife, some men will voluntarily become unemployed in order to avoid paying Virginia child support. However, the Department of Social Services may impute his income. You must go to the court to have your ex-husband's income imputed if he is voluntarily underemployed. If you suspect that your ex-husband has become unemployed or underemployed in order to avoid paying child support, contact a Virginia Beach divorce lawyer for assistance.
