How Mediation Works In Virginia Divorces (Part A)

Divorce can be messy. If you are facing a Virginia divorce you will no doubt have a lot of questions and wonder how you can ever make it through the stress and strain of figuring it all out. If there are disagreements about the children, marital property or any other number of things, it may seem you are in a no-win situation. However there is a way to help you muddle through the details and come to a peaceful resolution.

What Is Mediation?

Mediation involves a neutral 3rd party to help you and your spouse reach an agreement about the circumstances of your Virginia divorce. If you have any unresolved issues affecting your divorce, a mediator may be able to help both you and your spouse reach a compromise. The mediator has no authority or power over your specific case, which can take a lot of pressure off an already tense situation.

Mediation in Virginia can be especially helpful when it comes to determining child custody cases. Judges can provide you with a list of mediators, with court-ordered mediation being free. However, once you come to a verbal agreement it is important that you have your Virginia divorce attorney write the actual divorce agreement. Any agreements that come from a mediator are often difficult to enforce. Your attorney can make sure that your rights are protected throughout the process.

How Does Mediation in Virginia Work?

Mediation requires that you, your spouse and a mediator meet together in the same room. The mediator will assist both of you through the process in figuring out which issues need to be resolved and how best to resolve them. This will only work if you are comfortable around your spouse and you do not feel threatened by his presence.

The most important part of mediation is that the mediator remains a neutral 3rd party. This requires that the mediator offers no advice, legal or personal, to either party. A mediator may open up issues that need to be addressed. Negotiating takes place between you and your spouse with the freedom to say what you want. It's in your best interest to work with your Virginia divorce attorney to determine what you want to discuss prior to entering into mediation.
