Timeline for Virginia Spousal Support (Part A)

Going through a divorce is difficult, both emotionally and financially. Fortunately, you may be eligible for Virginia spousal support that can help you move on from your marriage and start your new life. The amount of Virginia spousal support you may receive depends on a number of factors, such as the length of your marriage and your current income.

Your Virginia Beach divorce lawyer will be able to give you specific legal advice about requesting spousal support in Virginia based on your marriage and financial situation.

Types of Virginia Spousal Support

There are several types of spousal support in Virginia including:

  • lump sum;
  • periodic payments;
  • temporary support; and
  • rehabilitative support.

You may also receive the right to ask for Virginia spousal support at a later time. The court will look at the circumstances of your case to determine which type of spousal support is appropriate, if any. In some cases, the court may award you a combination of different types of Virginia spousal support. Your Virginia Beach divorce lawyer can explain what type of Virginia spousal support is in your best interests.

Factors Used to Determine the Amount of Spousal Support in Virginia

When determining the amount and length of your Virginia spousal support, the court will look at 13 factors. You should work with your Virginia Beach divorce lawyer to come up with a response to each of the factors in order to help the court with its decision.

The factors used to determine spousal support in Virginia include:

  • The debt, income, and needs of each party, including pension, retirement plans, and stocks;
  • The standard of living to which you grew accustomed during the marriage;
  • The length of the marriage;
  • The physical condition, mental condition, and age of both parties;
  • Any physical condition, mental condition, and the age of a child that would make it difficult for one of the parents to work outside of the home;
  • Financial and nonfinancial contributions for the good of the family;
  • The property interests of each party;
  • The way in which the marital property will be split up;
  • The ability of each party to seek employment with his or her current skill and educational level;
  • The time, costs, and ability for a party to get further schooling and/or training in order to seek gainful employment;
  • The decisions made during the marriage regarding child-rearing. For example, if both parties agreed that one parent should stay home to raise the children, it may affect that parent's earning ability in the future;
  • The amount that either party contributed to the other party's education, training, or profession; and
  • Special factors, such as the tax consequences each party may face

Your Virginia Beach divorce lawyer can also help you identify any special circumstances that would entitle you to additional spousal support in Virginia.
