Virginia Divorce: Finding Health Insurance after Newport News

Charles Hofheimer, Attorney
A tough, no nonsense divorce and custody lawyer for women only.

When you get a Virginia divorce, there are many practical issues to address. The big questions of child custody and division of property may account for most of the court time and emotional stress, but there are other details, like health insurance, which can also have a significant impact on your life. A Newport News, Virginia divorce attorney can help.

In many cases, one spouse will put the other spouse and their children on their health insurance plan.  This allows the spouse and kids to have the peace of mind that comes with knowing that their health care will be taken care of should the need arise.

At the time of divorce, some people are under the false assumption that this coverage automatically continues for the spouse who isn't the primary person on the plan, but this is not the case. This is one of the difficult aspects of divorce; you no longer have a partnership with your ex, so he is no longer responsible for your health coverage.

For children, it's a different story. Parents are responsible for their child's health coverage until the child is of the age of majority, so your kids can remain on your ex's health plan, or they can be put on your plan when you get a new one. Either way, you and your ex will need to decide beforehand and be sure it's in your Virginia divorce agreement.

Healthcare Options After Divorce

You also have a few healthcare options of your own. If your coverage was through your spouse's place of work, you may qualify for Consolidated Omnibus Budget Reconciliation Act (COBRA) coverage. This coverage allows you to continue to retain the same benefits; the catch is that you will need to pay the full premium yourself. You should shop around because you may find that coverage through a private health insurance company is cheaper.

There are economical options for health care if you're between jobs or qualify as lower-income. Most states offer Medicaid or the equivalent coverage for families that can't afford traditional health insurance. There are also some non-profit organizations that run free or low-cost clinics for people who are uninsured.

The thought of being without health care coverage can be disconcerting, especially if you're already stressed due to your recent divorce. That's why it's important to seek out alternative health insurance options well before you lose your ex-husband's benefits. You do not want any gaps in your coverage.
