Calculating Spousal Support

If you are considering a Virginia divorce you may wonder how spousal support is calculated. Alimony, or spousal support, is determined using many factors unique to the financial circumstances of both you and your husband. Both parties' incomes, contributions to the marriage, and earning capacities are all taken into consideration.

Because so many elements come into play when calculating spousal support, many states have created spousal support guidelines to help provide a framework for how much the payer (spouse with the higher income) must pay the payee (spouse with the lower income).

In Virginia, the guidelines for spousal support include:

  • In cases involving child support: 28% of payer's gross income, less 58% of payee's gross income.
  • Where child support is not involved: 30% of payer's income, less 50% of payee's gross income.

According to Virginia law, spousal support is deemed appropriate only if the gross income of one spouse is at least 50% greater than that of the other spouse. However, there may be some exceptions to this rule.

The main purpose of Virginia spousal support is to ensure that the lower-earning spouse does not suffer undue financial hardship during and following the dissolution of their marriage. The amount of spousal support you may receive can also be subject to cost of living adjustments over time.

A Virginia couple is free to negotiate a spousal support amount and schedule that works for them, and can detail all this in their Virginia separation agreement.
